1.Who these terms are for
These terms apply to businesses, sole traders acting for business purposes, and organisations that buy through the Marketplace, in addition to the Marketplace Terms.
3.Orders and Payment Protection
Blackwellen Limited (Propvora, we, us) operates the Propvora online marketplace and software platform (the Marketplace). Propvora is the marketplace operator. The people who supply the work, services or stays that are bought through the Marketplace (Providers) are independent of Propvora, and each order is a contract between the buyer and the Provider. Propvora is not the supplier of that work, is not the Provider's agent, and does not supervise or warrant it, except for the Payment Protection and other platform services described in our documents.
Eligible business orders are paid as Protected Payments under the Payment Protection Terms, with release rules stated in the order.
4.Fees and tax
The price shown includes mandatory fees. Where the buyer is a business, the order shows whether payment processing costs are included, and whether tax applies to fees. See the Fees & Charges Schedule. Business buyers are responsible for their own tax treatment.
5.Cancellation and refunds
Cancellation and refund terms are stated in the order and the Marketplace Refund and Cancellation Policy. Statutory consumer cancellation rights do not apply to business buyers unless the law gives them.
6.Responsibilities of the organisation
The organisation is responsible for the accuracy of its instructions, for the legal duties that apply to its own business, and for choosing and instructing Providers. Propvora does not choose Providers or act on the organisation's behalf.
7.Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Otherwise, our liability is limited as set out in the Platform Terms.
8.Law
This document is governed by the law of England and Wales and the courts of England and Wales have non-exclusive jurisdiction, but if you are a consumer living in Scotland, Wales or Northern Ireland you may also bring proceedings in the courts of that nation, and the mandatory consumer law of the place where you live continues to apply.
