Buyer Terms Version 0.1 What buyers agree to when they order work or a stay through the Marketplace. 1. Who these terms are for These terms apply to individuals buying through the Marketplace. Businesses and organisations buying through the Marketplace are covered by the Business and Organisation Terms (/legal/business-terms). If you are a consumer, you are an individual acting wholly or mainly outside your trade, business, craft or profession. 2. Your contract Blackwellen Limited (Propvora, we, us) operates the Propvora online marketplace and software platform (the Marketplace). Propvora is the marketplace operator. The people who supply the work, services or stays that are bought through the Marketplace (Providers) are independent of Propvora, and each order is a contract between the buyer and the Provider. Propvora is not the supplier of that work, is not the Provider's agent, and does not supervise or warrant it, except for the Payment Protection and other platform services described in our documents. You will see who the Provider is, what is included, the price and when the work is expected before you order. The Provider's own terms and the details of your order form part of your contract. 3. Price and fees The price shown before you order includes any mandatory fee we charge you, such as the Propvora Service Fee, and any tax that applies. The total you will pay is shown before you pay. Optional extras are shown separately and are only added if you choose them. See the Fees & Charges Schedule (/legal/fees). 4. Paying Payment processing, the payment accounts used to receive money, transfers and payouts are provided by Stripe under Stripe's own terms. Propvora is not a bank, does not provide an account or wallet to anyone, and does not hold money as a deposit-taker. Where this document says that a payment is funded, awaiting release or released, it describes the status of a payment made through Stripe and the contractual release rules that apply to it. You authorise Stripe to take the payment shown at checkout. For eligible orders the payment is a Protected Payment under the Payment Protection Terms (/legal/payment-protection). 5. Delivery, approval and release When the Provider says the work is complete, you will be asked to review it. You can approve it, ask for it to be put right, or raise an issue. Where the order allows automatic acceptance after a review window, the window and the notice you will receive are stated in the order, and you will be told before release happens. Release is paused while an issue is open. 6. Cancelling and refunds Your right to cancel depends on the order. Consumers have statutory rights to cancel certain contracts, and the cancellation terms for your order are shown before you pay and in the Refund and Cancellation Policy (/legal/marketplace-refunds). Where work has started during the cancellation period at your request, you may need to pay a proportionate amount for what has been done. 7. If something goes wrong Contact the Provider first. If it is not resolved, raise an issue through the Marketplace. See the Marketplace Dispute Resolution Policy (/legal/disputes). You may also have rights against your card issuer; see Chargebacks explained (/legal/chargebacks). 8. Your legal rights Services must be provided with reasonable care and skill, as described and at the agreed price. If they are not, you may be entitled to repeat performance or a price reduction. Nothing in this document limits or excludes any right you have under mandatory law that cannot lawfully be limited or excluded, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 where they apply to you. 9. Law and contact This document is governed by the law of England and Wales and the courts of England and Wales have non-exclusive jurisdiction, but if you are a consumer living in Scotland, Wales or Northern Ireland you may also bring proceedings in the courts of that nation, and the mandatory consumer law of the place where you live continues to apply.
